1. Introduction

These Terms & Conditions ("Terms") govern the use of payment services provided by Youngs Capital (Pvt) Ltd ("the Company", "we", "us", "our") to merchants and end-users ("you", "your", "users").

By using our services, you agree to these Terms and to comply with all applicable laws and regulations of Pakistan.

2. Eligibility

You may use our services if you:

• Are 18 years or older, and legally capable of entering into a contract.
• Provide accurate, up-to-date, and verifiable identification in line with State Bank of Pakistan (SBP) KYC/AML guidelines.
• Have not been previously suspended or terminated from using our services for regulatory or security reasons.

We may suspend or terminate access if eligibility requirements are not met.

3. Account Registration

To access services, you must:

• Create an account with accurate personal or business information.
• Complete KYC verification by providing valid documents such as CNIC, proof of address, or business registration certificates.
• Maintain the confidentiality of your login credentials and promptly notify us of any unauthorized use.

4. Use of Services

You agree to:

• Use the services solely for lawful purposes and in compliance with these Terms.
• Refrain from engaging in or facilitating prohibited activities, including but not limited to:
  • Money laundering or terrorist financing.
  • Fraudulent or deceptive practices.
  • Transactions involving illegal goods or services.
• Abide by transaction limits and other operational requirements set by SBP and/or FastPay.

5. Fees & Charges

• We disclose all applicable fees before you initiate a transaction.
• Fees may vary depending on the type of transaction or service.
• We reserve the right to revise fees with prior notice, subject to SBP guidelines.

6. Transaction Processing

• Transactions are processed in compliance with SBP rules for PSP/PSO entities.
• Processing times may vary depending on network conditions and partner institutions.
• We are not responsible for delays caused by banks, payment networks, or other third-party providers.

7. Refunds & Disputes

• Refunds are handled according to our Return & Refund Policy.
• In case of a dispute:

  2. If unresolved within 7 business days, escalate to the SBP Consumer Protection Department.
• We strive to resolve all disputes in compliance with the SBP Consumer Protection Framework.

8. Data Protection & Privacy

• We collect, store, and process personal information in accordance with our Privacy Policy, the Personal Data Protection Bill of Pakistan, and SBP cybersecurity guidelines.
• By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

9. Security & Compliance

• We implement robust security measures, including encryption, transaction monitoring, and fraud detection systems.
• Users are responsible for keeping their credentials secure.
• We may suspend transactions that appear suspicious or violate AML/CFT regulations.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
• Our total liability for any direct damages is limited to the total fees paid by you for the transaction in question.

11. Termination

We may suspend or terminate services:

• If you breach these Terms or applicable laws.
• If required by regulatory authorities or law enforcement.
• With reasonable notice where possible, except in urgent compliance or security cases.

Users may close their account at any time, subject to settlement of outstanding obligations.

12. Amendments

We may update these Terms from time to time:

• To comply with changes in applicable laws or regulatory requirements.
• To improve services and security.

We will notify users of material changes in advance. Continued use of our services after such changes constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

• These Terms are governed by the laws of Pakistan.
• Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of [Lahore, Pakistan].
